1. Acceptance of these Terms
These Terms of Use govern your access to and use of ArizonaBiker.com, the Arizona Biker community, Business Directory, Events, My Arizona Biker, and related content and services (collectively, the “Service”). By using the Service, creating an Arizona Biker Member account, or submitting content, you agree to these Terms and acknowledge the Arizona Biker Privacy Policy.
If you do not agree, do not create an account or use the parts of the Service that require agreement.
2. Age requirement
You must be at least 18 years old to create an Arizona Biker Member account or submit content through the community. By creating an account, you confirm that you meet this requirement.
3. Member accounts
Arizona Biker uses WordPress user accounts for identity, authentication, passwords, password resets, sessions, roles, account status, and ordinary user administration.
You agree to:
- provide accurate, current information;
- keep your password and account access secure;
- use only your own account;
- promptly tell us at community@arizonabiker.com if you believe your account has been compromised; and
- keep your contact information current.
You are responsible for activity performed through your account to the extent permitted by law. We may require activation or other verification before allowing account access.
4. Community features and private personalization
My Arizona Biker may let you maintain a private profile, choose an Arizona Region and riding interests, save Businesses and Events, express interest in an Event, indicate that you are Planning to Attend, and manage communication preferences.
These choices are personalization tools. They do not create a public Member profile, direct-messaging account, public attendee list, ticket, reservation, registration, check-in, or guarantee of attendance.
“Interested” and “Planning to Attend” are expressions of intent only. If an Event requires official registration, tickets, waivers, payment, or another host process, you must complete that process separately with the Event host.
5. Businesses, Events, routes, and third-party information
Business and Event information may be provided by businesses, organizers, Members, public sources, or other third parties. Details can change. Unless we expressly say otherwise, listing a Business, Event, route, offer, organizer, or link does not mean that Arizona Biker owns, operates, sponsors, verifies, or endorses it.
Before riding, traveling, purchasing, or attending, verify current details directly with the responsible business or organizer, including dates, times, locations, road and weather conditions, eligibility, costs, rules, registration, safety requirements, insurance, permits, and cancellations.
Motorcycling and related activities involve serious risks, including injury, death, property damage, weather, traffic, road hazards, mechanical failure, and the acts of other people. You are responsible for your decisions, preparation, equipment, licensing, insurance, legal compliance, and safe operation of your motorcycle.
6. Content and Event submissions
Where submission tools are available, you may submit Events, corrections, descriptions, images, links, or other content (“User Content”). Submissions may be saved as a draft or pending review and are not guaranteed to be published. We may edit presentation, request clarification, reject, unpublish, or remove User Content when reasonably necessary to operate the Service, enforce these Terms, protect people or rights, or maintain quality.
You retain ownership of rights you hold in your User Content. You grant Arizona Biker a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, display, distribute, and make reasonable editorial changes to that User Content for operating, promoting, and improving the Service. This license ends when the content is removed, except for reasonable backups, records, prior distributions, and legal obligations.
You represent that you have the rights and permissions needed for your User Content and that it is accurate to the best of your knowledge. Do not submit content that infringes rights, invades privacy, is deceptive, unlawful, malicious, harassing, discriminatory, obscene, dangerous, or contains malware or unauthorized personal information.
7. Acceptable use
You may not:
- break the law or encourage unlawful or unsafe conduct;
- impersonate another person or misrepresent an affiliation;
- scrape, harvest, or use Member or contact information for unauthorized marketing, surveillance, or profiling;
- probe, bypass, disrupt, or abuse security, authentication, rate limits, or access controls;
- upload malicious code or interfere with the Service;
- copy or exploit the Service or its content in violation of intellectual property or other rights;
- submit spam, deceptive promotions, or unauthorized commercial solicitations; or
- use automated systems in a way that creates unreasonable load or violates instructions intended to protect the Service.
8. Email choices
Required account and security messages, such as activation and password-reset messages, are separate from optional marketing email.
The Arizona Biker newsletter, welcome sequence, and community updates require the applicable email choice and confirmation process. You can unsubscribe using the link in those messages or update your preferences in My Arizona Biker.
Event reminders and important Event updates require the separate “Keep me informed about this Event” choice for that Event and remain separate from the general newsletter. You can stop Event reminders using the Event-specific link or My Arizona Biker preferences.
9. Third-party services and links
The Service may link to or work with third-party websites and service providers. Their terms, privacy practices, availability, and content are their responsibility. Arizona Biker is not responsible for third-party services it does not control. Review their terms before using them.
10. Intellectual property
Except for User Content and third-party materials, Arizona Biker and its licensors own the Service, branding, design, software, and original content, subject to applicable licenses. These Terms do not transfer ownership to you. You may use the Service for its intended personal and community purposes, but may not reproduce or commercially exploit protected material without permission or another lawful basis.
11. Account suspension and termination
You may stop using the Service and may request account deletion through the available Member or privacy process.
We may limit, suspend, or terminate access when reasonably necessary to protect the Service, Members, third parties, or legal rights; investigate suspected misuse; comply with law; or enforce these Terms. When appropriate, we may provide notice or an opportunity to contact us. Suspension is not the same as deletion, erasure, or unsubscribing.
Sections that by their nature should continue after termination remain in effect, including intellectual-property, disclaimer, liability, dispute, and recordkeeping provisions.
12. Service changes and availability
We may change, suspend, or discontinue features and may correct or update content. We do not promise that the Service will always be available, error-free, secure, complete, or current. We will not silently treat a public Business or Event listing as dependent on an Arizona Biker Member account.
13. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” ARIZONA BIKER DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THE ACCURACY OR SAFETY OF THIRD-PARTY BUSINESS, EVENT, ROUTE, WEATHER, ROAD, PRODUCT, SERVICE, OR ORGANIZER INFORMATION.
Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARIZONA BIKER AND ITS OWNER, AFFILIATES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, REVENUE, GOODWILL, OR USE, ARISING FROM OR RELATED TO THE SERVICE.
OWNER/COUNSEL REVIEW REQUIRED: Insert an appropriate and enforceable cap on direct liability, along with any required exceptions for rights or liabilities that cannot lawfully be limited.
15. Governing law and disputes
OWNER/COUNSEL REVIEW REQUIRED: Confirm the operator’s state of organization, Arizona governing-law language, venue, informal-resolution process, and whether any arbitration or class-action provisions are desired and legally appropriate. No arbitration clause has been invented in this draft.
16. Changes to these Terms
We may update these Terms. We will post the current version and effective date and provide any additional notice or request renewed acceptance when required or when a material change warrants it. The version accepted during Member registration is recorded with the account’s consent history.
